Problems

Hi,

I have a few questions about my agent. I have been with mine since I graduated in July, I was sent a contract which I didn't sign until as I had some questions.

One of them being that the contract stated I had to stay with siad agent a whole year plus 3 months notice. I contacted them explaining I would like to discuss this and I heard nothing. The matter was brushed under the carpet and never mentioned again. I still haven't signed the contract nor has the agent (althought it is stated in the contract that I will received a signed copy).

I was also sent an invoice for money to go on their website, this I also questioned as I didn't want to pay money up front, and ignored.

So its 8 months later, I have no signed contract and I am not on the website. I have had 3 auditions since then and through discussion with others have not been put up for a lot of spotlight castings I could be suitable for.

My problem now is that I want to leave as I am leaving the area and want to start a fresh. I have emailed about this and it has been ignored and my calls rarely get answered on the phone.

Yeah, I agree with David. I don't see why you can't name the company in situations like these, especially if it helps other people.

Perhaps CCP admin would fill us in on why can't we mention a company name on a public forum? I mean you have your lil disclaimer thingie and I sometimes wonder why some threads get deleted or closed.

The company was still listed on my profile as my agent as of this morning, so I'm sure some people are aware of who it is. I don't want to go accusing them of being entirely a bad agent but this is my personal experience with them and it hasn't been great.

It has been a couple of hours now and still no reply although his response made it seem urgent. Also if he is that keen to keep me on and bound by this contract I'm not sure why he didn't ring me to discuss. None of it is adding up as a positive unfortunately.

Hopefully I will have some answers tomorrow.

First up please don't worry about this agency they are not worth it!!

There contract would appear to be unbalanced on may fronts - But the asking for money over web advertising puts the tin lid on it. This is purely to make money and not your cost!!

"The basic rule as to what constitutes an unfair contract term is that there is a significant imbalance in the terms towards one of the parties' rights and obligations. This imbalance will usually be detrimental to the consumer, and the trader will usually have shown a lack of good faith and will not have acted openly or fairly towards the consumer."

Your agent is showing this imbalance by asking for further payments for web recognition and also in there terms of ceasing trading with them. This would seem to be deemed unbalanced. They are trying to strong arm you and I suggest you inform them of this. Where in their contract did they mention costs for web advertising? An essential part of THEIR work!!

Hello,

Thanks to everyone for being so helpful. I received an email this morning saying that I am bound by the contract, (he didn't mention anything I had mentioned i.e equity etc.) however he would 'release' me as I am moving.

So kind of success
